MoxMe! has made great effort to design into its system levels of protection and validation that we think meet and exceed existing regulations and Internet practice. The reason is simple: We're kids and we don't want our friends getting into trouble.
This Kids' Privacy Policy is designed to answer your questions regarding our privacy policies and principles with respect to children under the age of 13. It's important, so please read this.
Building on our general Privacy Policy, we recognize the need to provide additional privacy protections when children visit the site on which this Kids' Privacy Policy is posted. We explain those additional protections here in this Kids' Privacy Policy. For your convenience, this Kids' Privacy Policy uses terms that are defined in our general Privacy Policy.
The Children's Online Privacy Protection Act ("COPPA") requires that we inform parents and legal guardians about how we collect, use, and disclose personal information from children under 13 years of age; and that we obtain the consent of parents and guardians in order for children under 13 years of age to use certain features of our Web site. Below we explain how we do that for these "kids." Also, when we use the term "parent" below, we mean to include legal guardians.
For the purposes of this page one, when we refer to 'kids', we are referring to children under 13 years of age.

What types of personal information do we collect about kids?

Kids can view the main home page for www.moxme.com without any personal information being collected. We do not collect personal information from kids unless they register on www.moxme.com; however, only children 13+ years of age are allowed to register. Kids aged 12 and younger are not allowed to register at www.moxme.com. Typically, users will register in order to participate in communications with their peers and group leaders, as part of a group at school or in the community. Since elementary and middle schools use our system - as do countless community and other groups - it is important for these entities to be able to find and invite the kids who are part of their groups. Often these entities do not know the parents or other guardians of the kids, and use the MoxMe! system to build these personal relationships. As such, since it is important for kids to have presence in MoxMe! and since kids are not eligible to have their own accounts, their parents must establish an alias presence on their behalf. Note that a presence is not the same as an account; once a presence is established, the kid's name and other parent-entered information about the kid are visible as an extension of the parents' account. If a user in MoxMe! selects a kid's identity for communications, they are actually selecting the parents' account via an alias.
As such, the only information we do not directly collect information from kids. During our registration or subsequent account maintenance process, the parent enters a kid's first and last name, and kid's birth date. The kid's name will appear as an alias in the system next to the parent's name, as mentioned above. We collect birth dates to validate the ages of our guests, including kids. We do not collect any other personally identifiable information regarding kids during our registration process, and any subsequent information about kids entered by parents is on an optional, opt-in basis.
We may prompt and subsequently collect personal information about their kids from parents in order to allow kids to have a better presence in the MoxMe! system. These features may include the optional entry of city and state of residence, or the uploading of a picture of a kid in order to make group identification of their child easier in MoxMe! (in instances, for example, where many kids with the same name reside in the same area). They do not include one to one instant message, sending email, posting on message boards, and other similar activities - kids are not allowed this level of participation in MoxMe! until they are 13 years of age. In all instances, not only do parents have the option of not entering this information, but also of choosing the level of visibility of any entered data within the system (limiting, for instance, the viewing of a picture to only those people in your kid's existing groups).

How do we use and share the personally identifiable information that we have collected about kids?

To personalize communications to a kid regarding a specific group (such as their school soccer team), we may use the kid's first and last name, combined with a parent's first and last name and an address optionally provided by the parent, when displaying search results within the system, or when showing a listing of group members. The parents have the option of not displaying all but the name information in the system, or limiting its view to no one or to only people within their existing groups. We do not collect a kid's email address from the parent in order to send the kid any messages; kids are not allowed to have an account in the system for which the email address would be required. The purpose of MoxMe! is to enable group communications. As such, taking part in these activities may involve disclosure of a kid's personal information to third parties who are involved with these groups. In addition, we may share a kid's personal information with third parties to the extent reasonably necessary to: protect the security of integrity of our site; to take precautions against liability; to respond to judicial process; or to the extent permitted under provisions of law, to provide information to law enforcement agencies or for an investigation related to public safety.

How do we notify and obtain consent from parents for the collection of information from their kids?

Kids - again reiterating the definition of 'kid' as being under the age of 13 - are not allowed to be in our system unless they are entered by a parent or guardian, or other trusted party such as a school, first. All information regarding a kid is required by our system to be confirmed by the parent in order to be active - therefore prior consent is built into each aspect of the system. MoxMe! makes reasonable effort to try to confirm that a parent is the adult that they claim to be, through its validation process. We require a high level of verification to confirm that the parent has given permission for the release of kid information. For example, we may require a parent to provide us credit card information, speak to a trained telephone operator or return by postal mail or fax a signed consent form.

How can parents access, change or delete personally identifiable information about their kids?

At any time parents can change all aspects regarding their kid's presence in MoxMe!, including removing the child from the system. The parent has full control over the presentation of all aspects of the child's information, even to the extent of making all information regarding their child invisible to others in the system. We use two methods to allow parents to access, change, or delete the personally identifiable information that we have collected from their kids.

How will we notify parents if our Kids' Privacy Policy changes?

We may amend our Kids' Privacy Policy at any time. We will provide parents notice by email (and/or by their Normal settings of their MoxMe! communications preferences) of any material changes in the way we intend to collect, use, and/or share kids' personal information. Please note that, at all times, parents should update their personal information to provide us current email addresses. We will apply material changes in our Kids' Privacy Policy only in conformance with applicable law, including any applicable provisions of COPPA that require parental consent.
